TERMS OF SERVICE
⇁ General
In contacting and agreeing to receive artwork from me, clients enter a contract with me and agree to all terms as located on this page, which will not be superseded by any other terms unless explicitly agreed upon by myself and the client.Where there are multiple character owners per image, but only one individual purchasing, these terms will extend to the owners of any characters depicted in the image.
In contacting and agreeing to receive artwork from me, the client also agrees and affirms that they are at least 18 years old.
Any and all business will be done through my e-mail OR Twitter DMs after initial discussion through E-mail.
I will send you an image on each completed stage of the commission (sketch/pose, clean sketch, lines, etc) to make sure there are no corrections needed. Linework and beyond that need edits will require extra unless it's something that I have forgotten, then it is free of charge.
I retain the right to change and alter my Terms of Service and prices at any time. If you have already paid, what Terms where available when the payment is made are the ones that will apply to you.
I reserve the right to showcase all commissioned work on any of my personal websites and galleries. For time-sensitive work (birthday gifts, anniversaries, etc.) I may delay public showcase at your request. I will not accept commissions intended to stay private forever, or for an indefinite amount of time.
I retain all the rights to the commissioned artwork, including the right to make prints and merchandise for sale, to include it in image packs, and to alter the commissioned work to make it more generic for print, if I choose. The purchase of image rights can be negotiated.
You will retain the right to your own characters. This does not mean you own the copyright to the image.
Any piece provided and made by me are not to be taken and made profit off of by any circumstances. This includes things such as selling personal prints, image packs, and various other merchandise with the image on it.
Copyright purchasing can be discussed on a piece-to-piece basis.
Clients are allowed to make prints for personal use and as gifts. Clients may also edit and change the artwork to make icon’s, wallpapers and other graphics to be used non-commercially but are not allowed to alter the art itself.
Any art posted by the client must be a smaller resolution (half or lower) of what is provided, keeping the signature present. A low resolution and high resolution image will be provided upon completion.
Under no circumstances is my work to be made into, or recreated for NFT (non-fungible token) purposes.
I will not work with anyone or anything indulging in AI generated artwork, and my art is not and will never be available for use by any such means.
⇁ Payment
Payment is due after details have been established and a price has been agreed upon.
Invoice will be sent to you VIA provided e-mail in form. If it is a seperate e-mail to your contact e-mail please make it clear which is which.
Once you are prompted to pay via invoice, commission must be paid in full within one week. Additional time will be allowed in the event of circumstances beyond the clients control. After the initial pay-period and any extension I reserve the right to cancel the commission due to lack of payment.
Payment plans are only available for commissions totaling $50 dollars or higher. Anything below that price must be paid in full at one time. Work will only begin if paid in full, including in payment plans.
All prices, including any quote that has been provided are non-negotiable. Payments are accepted in USD only, and are currently only accepted VIA paypal.
Any quote given for work to be commissioned at a later date will be valid for 60 days (2 months) from the time they are given. Beyond that, a commission price must be re-negotiated with the client. This does not include sale-priced commissions.
Under the circumstance that you wish for your piece to be completed before a certain date, or to be advanced in the queue a fee of up to 100% of the quoted price may be additionally added to compensate for a tight time-frame.
⇁ Revisions and Delivery
Client will be given the opportunity to direct any sort of revisions of their commissions during the rough sketch and clean-sketch stages. I will do my best to tweak and change as needed, but I reserve the right to extend fees if the changes become too frequent and diverge from the original description and idea given.*
*If I am the one who missed something or made an over sight there is no additional fee expected. I can be forgetful so do not be afraid to point out if I seemed to have forgotten an element you wish to have displayed in your characters illustration.
For all commissions, minor revisions can be made after the work is complete, especially where I have failed to include something that was present the original description or references. Major revisions may incur separate fees.
Minor revisions: chances to hands or feet, changing facial expressions, small accessories like jewelry, adding small simple markings.
Major revisions: changes to position of limbs or torso, adding new clothing, significant changes to markings (e.g. changing spots to stripes).
Upon completion of your commission, you will receive a smaller web-copy of your commission for sharing, as well as a higher resolution copy for personal viewing. Both of these files will be PNGs.
Seldom will I ever work on a set canvas size. To avoid revision fees should you wish to have more static dimensions, please request for them (i.e 8x10in canvas).
⇁ Regarding Speedpaints
Once production of finished drawing is completed, I will provide you whatever is necessary to find if said product meets your desires. If so, I'll begin work immediately on the commissioned speed painting.
This will take anywhere from a couple of hours to a week depending on how busy I am, and will (usually) include a 60 second version and a 5-10 minute version with music overlaid and various zooms of said art piece.
Once vides(s) is/are completed, all will be delievered to you through your provided e-mail.
Long form copies will generally be posted to my youtube, and the shorter clips to my Twitter.*
*Under the circumstance you wish for a private/personal only copy, be it separate from the public one with different music and editing or for personal viewing an doubled fee of original cost of the production will apply.
⇁ Refunds, Cancellations, and Refusals
If the client cancels their commission during or after payment, but before work has begun, you will be refunded, but I will retain 5% of the total cost of the commission as a convenience fee.
If the client cancels during the sketch/thumbnail stage phase, a 50% refund of the original cost will be issued.
If the client cancels during the line/color stage, or after the commission is complete, no refund will be issued.
If I am the one to cancel the commission, up to 95% of the payment will be refunded to the client*. I can cancel and refund a commission for reasons including but not limited to:
Rude or inappropriate behavior.
Poor communication or failure to communicate in effective English.
Unforeseen inability to complete the commission.
* Depending on completed amount of work, and accordant to case-by-case basis, a lesser amount may be refunded to compensate for work spent.
When a commission is cancelled before it is complete, the client may keep the incomplete art. I still hold copyright to the art, and left-over art may not be altered or completed by another without permission.Even for commissions that are not cancelled, I may recycle sketches/thumbnails that were rejected by the client for other works.I may turn down requests to draw a character that does not belong entirely to the client. If you ask me to draw someone else’s character, I may ask that the owner contact me and give me permission to do so, and they must understand at least the general idea of what’s being drawn. If the commission is intended to be a surprise or gift, I may refuse if I have any suspicion the character is being used without the owner’s consent or otherwise against their wishes.**Refunds will be issued through payment plans on my behalf in order to avoid any extreme financial strain.**

Adoptables & Info
Hello there! I'm assuming if you're looking here you're looking to adopt one of the designs I produced. If that is the case, please be sure to read the following ToS thoroughly, as it'll provide to you all necessary information required to make the adoption process as smooth as possible for both of us.
⟶ Information
Both general information as well as what can be classified as Terms of Service as correlated with the ownership and/or purchase of an adoptable design from me.
Payment plans can be discussed on adoptables valued of/above the price of $50 USD in value.
All files excluding the low resolution unwatermarked version will be released to you after final payment. Low resolution unwatermarked copy will be sent upon first payment being received.
All adoptables are only purchasable through invoices. Do not send any payment through Ko-fi, paypal.me or other means.
You will recieve a 10% discount on future commissions with any adopted designs from me, accumulative to a possible total of 35% off.
You become the official copyright holder of the design upon final transaction. If designs are purchased with potential marketing use in mind, further cost may incur.
If you seek to resell in the future the cost must not exceed that of initial total and final agreed upon cost of the adopt excluding if there is an addition of extra content in addition to initial design.
Under no circumstance may any of my designs be resold as NFTs, regardless of whether or not you have purchased the design. You have purchased the design, not my art.
Adopt may not be fed into AI generative machines to create more images using said design or anything of my arts likeness.
